In short

  • You are an independent contractor, not our employee or worker. You choose when you ride and who you work for, and you do not have to accept any work from us.
  • We lend you a screen bag. It stays ours, so please look after it and return it when you finish.
  • Follow the Highway Code, and never touch or look at the screen controls while riding.
  • The bag records its location only while it is switched on, and you choose when it is on. It has no camera.
  • We pay you £100 a week for carrying and running the bag in any week you meet the qualifying conditions. You are responsible for your own tax and National Insurance.
  • Either of us can end the arrangement at any time with [7] days' notice.

1. About these terms

  1. These terms (the Terms) apply between you and [Company legal name] Ltd, trading as Curb Network, a company registered in England and Wales under company number [Company number], with its registered office at [Registered address] (Curb, we, us).
  2. The Curb rider programme (the Programme) lets independent couriers earn extra income by carrying a delivery bag fitted with a digital advertising screen (the Bag) while they do their normal delivery work in London.
  3. You accept these Terms when you [sign them electronically during onboarding / collect your Bag; confirm the acceptance mechanism]. Please read them carefully and ask us if anything is unclear. You can contact us at hello@curbnetwork.com.

2. Your status

  1. You take part in the Programme as an independent contractor in business on your own account. You are not an employee or worker of Curb, and nothing in these Terms creates a partnership or agency between us.
  2. You decide whether, when, where and for how long you ride with the Bag switched on. We do not set shifts, routes, areas or working hours, and you are never required to ride anywhere for the purpose of showing advertising.
  3. We are not obliged to offer you work, and you are not obliged to accept any work from us or to carry the Bag in any particular week. If you do not meet the qualifying conditions in a week, the Weekly Fee (see the section on payments) is not payable for that week.
  4. You are free to work for any delivery platform or other business, including at the same time as taking part in the Programme, subject only to the section on delivery platforms below.
  5. You are responsible for your own tax and National Insurance contributions, and for registering as self-employed with HMRC where required. We will not deduct tax or National Insurance from payments unless the law requires us to.
  6. You are not entitled to holiday pay, sick pay, pension contributions or other employment benefits from Curb.

3. Eligibility

  1. To join and stay in the Programme you must:
    1. be at least 18 years old;
    2. have the right to work in the UK [confirm whether Curb carries out right-to-work checks];
    3. be actively working as a delivery courier in London;
    4. use a bicycle, e-bike, cargo bike or moped that is roadworthy and, where the law requires, registered, taxed and insured [confirm eligible vehicle types]; and
    5. hold any licence the law requires for your vehicle.
  2. You must give us accurate information when you apply and tell us promptly if anything changes, including if you stop meeting any of the requirements above.

4. The equipment

  1. We will lend you a Bag, a charger and any accessories listed in your equipment receipt (together, the Equipment). The Equipment remains our property at all times. It is lent to you personally, and you must not sell, lend, hire out, give away or pledge it.
  2. [Deposit: state whether a refundable deposit is required, its amount, and when it is returned. Delete if not used.]
  3. You must take reasonable care of the Equipment. In particular, you must:
    1. charge it using only the charger we provide, following our charging guidance, and never leave it charging unattended overnight or near anything flammable [confirm battery safety guidance];
    2. not open, modify, repair, tamper with, or try to access the software on the screen, battery or electronics;
    3. not cover, deface or add stickers to the screen or the Curb branding;
    4. keep the Bag clean and, if you carry food in it, follow good food hygiene practice [confirm whether the Bag is also used as the insulated delivery bag]; and
    5. store it securely when you are not using it, and never leave it unattended in a public place.
  4. You must tell us within [24 hours] if the Equipment is lost, stolen, damaged or not working properly. If it is stolen, you must report the theft to the police and give us the crime reference number.
  5. Fair wear and tear is our responsibility, and we will repair or replace faulty Equipment free of charge. If Equipment is lost or damaged because you did not take reasonable care of it, or it is not returned, we may charge you [the reasonable cost of repair or replacement, up to a maximum of £X].
  6. We may remotely lock, update or switch off the Bag, for example to install software updates, if it is reported lost or stolen, or after the Programme ends.

5. Safe riding

Nothing in these Terms requires you to do anything unsafe. Your safety, and the safety of everyone around you, comes before showing advertising.

  1. You must comply with the Highway Code and all road traffic laws whenever you ride with the Bag, including rules on lights, helmets (strongly recommended for cyclists), where you may ride, and the use of mobile devices.
  2. Never use the screen while riding. The screen runs automatically and does not need any input from you. You must not touch, adjust or look at the screen or any Curb app while you are moving. If you need to check or adjust anything, first stop somewhere safe and legal.
  3. Wear and adjust the Bag as shown in our fitting guidance, so that it is secure and does not restrict your movement, balance or view, or block your lights or reflectors.
  4. If the Bag becomes damaged, overheats, smokes, or makes an unusual smell or noise, stop as soon as it is safe, switch it off, move it away from yourself and others, and contact us. [Confirm battery safety instructions.]
  5. You must not ride under the influence of alcohol or drugs, or when you are too tired to ride safely.
  6. You must not change your route, speed or behaviour to increase advertising exposure in a way that puts you or others at risk.
  7. If you are involved in an accident or incident while carrying the Bag, make sure you and others are safe first, then tell us as soon as reasonably possible.

6. Delivery platforms

  1. Your relationship with any delivery platform you work with is separate from these Terms. Curb is not affiliated with, and does not act on behalf of, any delivery platform unless we tell you otherwise.
  2. You are responsible for checking that the terms of any platform you work with allow you to carry the Bag. If a platform tells you that you may not carry the Bag, please let us know. [Consider how Curb supports riders on this point.]
  3. We will not share your personal data or location data with any delivery platform unless the law requires it or you ask us to.

7. Location data and your privacy

  1. The Bag contains a GPS unit. It collects location and telemetry data only while the Bag is switched on and active. When you switch the Bag off, it stops collecting and sending your location. [Confirm hardware behaviour, including any "find my bag" ping when off.]
  2. While active, the Bag records its location, speed, heading, the time, the screen ID, and technical data such as battery level and screen status, and logs each advert it plays. The Bag has no camera, no facial recognition and no sensors that capture people nearby.
  3. We use this data to show adverts in the right areas, produce proof-of-play reports for advertisers, check whether you have met the qualifying conditions for the Weekly Fee, keep the Equipment working, find lost or stolen Equipment, and investigate incidents or misuse.
  4. We do not use location data to monitor or manage your delivery work, and advertisers only receive aggregated reports that do not identify you.
  5. You can switch the Bag off whenever you want, for example on breaks, at home or when you are not working. Please switch it off at the end of each session.
  6. Our Privacy Policy explains in full how we use your personal data, how long we keep it and what your rights are.

8. Payments

  1. We will pay you £100 a week (the Weekly Fee) for carrying and running the Bag in each week in which you meet the qualifying conditions: [set out the qualifying conditions, for example a minimum number of active hours or active days per week].
  2. We pay the Weekly Fee in arrears on [payment day] by [payment method, for example bank transfer to the account you give us]. We use the Bag's activity data to check whether you have met the qualifying conditions.
  3. We will provide a statement for each payment showing how it was worked out. [If self-billing is used: you agree that we will issue self-billed invoices on your behalf, and you will tell us if you become VAT registered.]
  4. If you think a payment is wrong, tell us within [30] days of receiving the statement and we will look into it.
  5. Active time only counts towards the qualifying conditions while you are carrying the Bag during genuine delivery activity in the public street. We may withhold payment for, and recover payments made for, activity that is not genuine, such as leaving the Bag switched on while stationary at home, falsifying or interfering with location data, or carrying someone else's Bag. We will explain our reasons and give you the chance to respond. [Confirm and define idle-time rules.]
  6. We may change the Weekly Fee or the qualifying conditions by giving you at least [14] days' notice. If you do not agree to the change, you may leave the Programme.

9. Insurance

  1. You are responsible for having any insurance required by law or by the delivery platforms you work with, including vehicle insurance if you ride a moped or other motor vehicle.
  2. [Describe any insurance Curb provides: for example, insurance of the Equipment against theft and accidental damage, and public liability cover for injury or damage to third parties caused by the Bag itself. State the insurer, key limits and exclusions, and how to make a claim.]
  3. [State whether riders must hold their own public liability or personal accident insurance, and whether Curb requires proof of it.]

10. Conduct

  1. While carrying the Bag you represent the Curb network in public. Please be courteous and respectful to the public, other road users and businesses.
  2. You must not display your own content on the screen, change what it shows, or speak publicly on behalf of Curb or any advertiser.
  3. If a member of the public complains to you about an advert or the Bag, please give them our contact email and let us know.
  4. If you are uncomfortable carrying any particular advert, tell us. [Confirm whether riders can opt out of specific advertising categories.]

11. Returning the equipment

  1. When you leave the Programme, for any reason, you must return all Equipment, clean and in good condition (fair wear and tear excepted), within [7] days to [return address or drop-off point], or arrange a collection with us.
  2. We will check the Equipment when we receive it and tell you within [14] days if there is any damage beyond fair wear and tear.
  3. If you do not return the Equipment, we may switch it off remotely, use its last known location to recover it, charge you as set out in the section on equipment, and take other lawful steps to recover our property.

12. Ending the arrangement

  1. You can leave the Programme at any time by giving us [7] days' notice by email. We can end your participation at any time by giving you [7] days' notice.
  2. We may end your participation immediately, or suspend it while we investigate, if you:
    1. ride unsafely or use the screen while riding;
    2. tamper with, misuse or fail to take reasonable care of the Equipment;
    3. falsify or interfere with location or activity data, or otherwise act dishonestly;
    4. behave in a threatening, abusive or discriminatory way while carrying the Bag; or
    5. no longer meet the eligibility requirements, or seriously or repeatedly break these Terms.
    Where appropriate, we will tell you why and give you the chance to explain before we make a final decision. [Confirm an appeal process.]
  3. We may pause or close the Programme, or reduce the number of riders, for business reasons, by giving you at least [7] days' notice.
  4. When your participation ends, and once the Equipment has been returned, we will pay you any Weekly Fee earned up to the end date, less any sums you owe us under these Terms.

13. Liability

  1. Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited or excluded by law.
  2. We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care, including any injury caused by a defect in the Equipment.
  3. We are not responsible for loss of income from delivery platforms or other work, or for any other loss that was not foreseeable, except where caused by our negligence.

14. Changes to these terms

We may update these Terms, for example to reflect changes in the law or the Programme. We will give you at least [14] days' notice of any change that affects you. If you do not agree, you may leave the Programme before the change takes effect.

  2. These Terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction. This does not affect any statutory rights you may have.
